1. Service Definition

By using the logistics hub of Smart Transport LLC, the user (Shipper/Broker/Carrier) agrees to be bound by these terms. We act as a transportation provider facilitating the movement of goods across North America.

2. Liability (Carmack Amendment)

Liability for cargo loss, damage, or delay is governed by 49 U.S.C. § 14706. Smart Transport LLC maintains cargo insurance; however, total liability is limited to $100,000 per load unless a higher valuation is declared and accepted in writing prior to pickup.

3. Detention & Layover

Standard loading/unloading time is 2 hours. Smart Transport LLC reserves the right to assess detention charges for delays exceeding this window. Layover and TONU (Truck Order Not Used) fees apply as per the current market rate schedule.

4. Jurisdiction

This agreement is governed by the laws of the State of Colorado. Any disputes arising from services provided by Smart Transport LLC shall be handled in the courts located in Morgan County, CO.
